Immigration Enforcement

287(g) Program

The 287(g) program is an agreement between local law enforcement agencies and Immigration and Custom Enforcement (ICE) that gives local law enforcement the authority to enforce immigration law. Six counties (Alamance, Cabarrus, Gaston, Henderson, Mecklenburg, and Wake) and one city (Durham) in North Carolina are in partnership with ICE through a Memorandum of Agreement (MOA). There are many reasons for which the 287 (g) program must be terminated: 1) the majority of people are deported for misdemeanor infractions 2) there is high risk of racial profiling towards minorities 3) lack of transparency in the process 4) immigrants are fearful of reporting crimes making our communities less safe. Secure Communities

Secure Communities (S-Comm) is a federal enforcement program designed by the Department of Homeland Security (DHS) to identify “criminal” undocumented immigrants held in US jails. When a person is arrested and booked into a local jail, the fingerprints of the individual are run through the FBI’s and ICE’s database, if the individual is identified as an undocumented immigrant ICE is notified automatically. In March of 2011, S-Comm expanded to all 100 counties in NC. Although this program is designed to identify criminals; most of those that have been deported through S-Comm are non-criminals; furthermore, the immigrant community has become afraid to report crimes.
