Immigrants arrested or detained by Immigration have certain rights. However, these rights change if they are arrested at the border or in the airport. In those cases, immigrants may have fewer rights. If you are arrested, it is important to remain calm and remember the following tips: You have the right to remain silent. Ask for a call to your attorney. Do not sign anything. It may be that by signing, you will dispose the right of a lawyer or appear before a judge.
• Write down the name and telephone number deportation attorney who is assigned to your case
• Do not accept "voluntary departure" without talking to a lawyer. Sign a voluntary departure agreement means you must leave the United States.
• Do not assume that the immigration officers or the judge will explain your options, or give you the correct information.
• You have the right to call a lawyer or your family if you are detained. You have the right to receive visits from a lawyer if you have been arrested
• You have the right to have a lawyer, but the government will not pay or provide one.
• When you talk to your lawyer, you should tell him or her everything you consider important about your immigration status, even if you have been arrested for committing a crime. It is important that any person giving legal advice knows all about your case, so it can bring you the best advice.
RESPONSIBILITIES:
• Be polite, stay calm.
• Never lie or give false information to an immigration agent.
• Do not carry a fake ID.
• Have the name and phone number of an immigration attorney.
IF YOU ARE ARRESTED:
You do not have to answer any questions.
If you do not have a lawyer, ask for the list of free legal services from their local area.
• Ask for an interpreter if you do not understand fully.
• Do not sign any document in a language that you do not understand.
My rights card
I am giving you this card because I do not wish to speak to you or have any further contact with you. I choose to exercise my right to remain silent and to refuse to answer your questions. I want to speak with a lawyer before answering your questions.
